Jason K. Schmitz has a comprehensive global intellectual property practice that includes transactional, prosecution and litigation experience.
His transactional IP focus includes extensive experience in evaluating, structuring and managing commercial transactions including IP due diligence for stock and asset acquisitions, divestitures, mergers, joint ventures and strategic alliances involving U.S., foreign and multinational corporations as well as transactional work for early to mid-stage companies. Clients rely on him for assistance in connection with a broad variety of commercial agreements such as technology transfer agreements, software, trademark, patent and know-how licenses, marketing, sales and distribution agreements, joint development agreements, intellectual property assignments and security interest agreements.
Mr. Schmitz has extensive experience in evaluating, structuring, negotiating and managing information technology transactions in a wide variety of industries. He regularly advises multinational companies, startups, emerging growth companies and non-profits on technology development, distribution, license and service agreements relative to their domestic and foreign operations. Mr. Schmitz provides guidance in connection with technologies related to data analytics, internet of things, smart cities, “as a service” platforms and e-commerce. He also has experience representing companies in connection with licensing enterprise systems and contracting for systems integration and systems development. Jason also has significant experience advising clients in connection with data privacy issues and acts as outside general counsel for many of his clients by managing all of their legal needs through his own experience and the expertise of his trusted network of U.S. and international attorneys.
Mr. Schmitz partners with his trademark clients on all aspects of U.S. and global brand management, supporting all stages of brand positioning in the marketplace, from development to brand protection, enforcement and monetization. He has represented some of the world’s largest brands in the sports, financial, telecommunications and food and beverage industries in connection with the management of their global trademark portfolios. His global brand management work includes representation of clients before United States and global regulatory and enforcement boards, including the U.S. Patent and Trademark Office’s (USPTO) Trial and Appeal Board (TTAB) and the World Intellectual Property Organization (WIPO) as well as in federal court.
In addition to his substantial IP credentials, Jason also has significant experience representing for profit and not-for-profit sports clubs in connection with all aspects of club management and legal issues. He serves on the Board of Directors of an Illinois-based competitive youth soccer club and is actively involved in charitable work with K9s for Warriors and various children’s museums in the Chicago area.
Jason holds a bachelor’s degree with honors in International Relations and Political Theory from Michigan State University’s James Madison College. He graduated law school with Honors from DePaul University College of Law. Jason is active member of multiple bar and industry associations including the International Trademark Association (INTA) and the Chicago Council on Global Affairs. A thought leader in the area of intellectual property, Jason’s articles are featured in numerous publications including the Northwestern University School of Law Journal of Technology and Intellectual Property and The Licensing Journal.
